Administrative bodies have to understand that there is no choice but to implement decisions: Justice Mansoor Ali Shah
ISLAMABAD: Justice Mansoor Ali Shah, the senior-most judge of the Supreme Court, has termed the implementation of the supreme court's decisions as a constitutional requirement and said that it cannot be kept in mind that the decision of the Supreme Court cannot be implemented, the administrative bodies have to understand that they have no choice but to implement the decisions.
Addressing a conference to mark the 10th anniversary of the court's decision on the rights of minorities in Islamabad, Justice Mansoor Ali Shah said that I was called the acting Chief Justice of Pakistan, which is not correct.
Justice Mansoor Ali Shah said that I am the senior-most judge, not the acting Chief Justice, Justice Qazi Faez Isa is my friend and he is the Chief Justice of Pakistan.
The senior-most judge of the Supreme Court said that Chief Justice Qazi Faez Isa is healthy and energetic.
Justice Mansoor Ali Shah said that our constitution is very beautiful, sadly the 2014 decision of the Supreme Court could not be implemented, the Supreme Court gave a decision in 2014 regarding the fundamental rights of minorities, it is not possible that the supreme court's decision will not be implemented but there is an example here.
He said that everyone is sitting here and they will understand that if the decisions of the Supreme Court are not implemented in such a way, then it is not so, the decisions of the Supreme Court would have been implemented completely and this is the structure of the Constitution.
He said that recently we have said that keep in mind that the decision of the Supreme Court cannot be implemented, if it is thought, then the constitution will be violated, the administrative institutions have to understand that they have no choice but to implement the decisions of the Supreme Court. This power is taken from the Constitution and not from any other document.
Justice Mansoor Ali Shah said that no one has the choice that it is not right, it is wrong, the constitution says that this is a decision, it should be implemented, or change the whole structure and make something else, but according to the constitution and the structure of the constitution at this time, this is the position, no decision or order can be rejected or delayed, otherwise the whole legal system. If you walk in the direction that the decision should not be implemented, then it cannot happen.
"It is also against the division of powers, gives us work under the division of powers, gives a task to the administration and gives a task to the legislature, otherwise you will make this system completely imbalanced, it is the basic component of democracy and it should not be disturbed," he said.
He said that we have said in the Supreme Court that it is not a favor or a burden to follow the decision, but it is a constitutional responsibility and we have to follow it and no administrative powers should be exceeded.
Justice Mansoor Ali Shah said that if the Supreme Court has given a decision, then it has to be implemented and this is the system and constitution of this country.
He said that it has become clear that the implementation of decisions is a constitutional requirement, otherwise it has serious consequences, I am making it clear because here we are seeing that a decision is going on for a long time and it is not being implemented, then it will not happen, we will also see this decision.
The senior-most judge said that according to my powers, I will implement the decision in its spirit.
Talking about minorities, Justice Mansoor Ali Shah said that the decision regarding the rights of minorities will be implemented insha Allah, minorities have full religious freedom in the constitution.
He said that a court decision was made in Mubarak Ali case in which quotas were given to minorities in jobs, we need interfaith dialogue in the country, all religions say to take care of each other.
He said that we have to come towards patience, as a citizen, I am saying that patience will bring peace in the society, due to patience, not only the society will progress but it will increase jobs, due to intolerance, unrest comes in the society and creates division, violence will cause the country to suffer economic misery, development will stop, I want the government to implement these measures.
